WHY 2026 CHANGES EVERYTHING

The nicotine pouch industry is changing. The FDA authorized ZYN nicotine pouches in January 2025. This was the first authorization for nicotine pouches in U.S. history. The agency launched a pilot program in September 2025 to speed up reviews. Six on! PLUS products received authorization in December 2025. You must prepare for a larger market. Compliant brands will lead in 2026. Non-compliant businesses will face enforcement.

WHAT CHANGED IN 2025

The FDA shifted its approach. For 15 years, the agency treated new nicotine products as harmful. Every application had to prove a public health benefit. Reviews took 2 to 3 years. Many applications failed.

The ZYN authorization changed this. The FDA now acknowledges several facts:

  • Nicotine pouches carry lower risks than cigarettes.
  • Pouches contain fewer toxic chemicals than other tobacco products.
  • Youth use remains low despite market growth.
  • Pouches help adult smokers switch to alternatives.

THE PILOT PROGRAM

The FDA started a pilot program for nicotine pouch applications in September 2025. This program changed the process:

  • Reviews now take 6 to 12 months instead of 3 years.
  • The FDA communicates with manufacturers in real time.
  • Study requirements are lower.
  • Clear benchmarks define acceptable evidence.

The on! PLUS authorizations in December 2025 prove this process works.

FEDERAL COMPLIANCE REQUIREMENTS

1. AGE VERIFICATION

You cannot sell nicotine pouches to anyone under 21.

For Retailers:

  • Check photo ID for any customer who looks under 40.
  • Record every sales refusal to a minor.
  • Train your staff on ID checks.
  • Use a point of sale system that requires age verification.

For Wholesalers and Distributors:

  • Confirm your retail customers have valid tobacco licenses.
  • Do not sell to unlicensed stores.
  • Keep copies of customer licenses.

Penalties:

  • Civil fines reach 100,000 dollars per violation.
  • Criminal fines reach 250,000 dollars.
  • You may lose your license or face prison.

2. PMTA AUTHORIZATION

You must only sell products with FDA approval.

For Retailers and Wholesalers:

  • Check the FDA Searchable Tobacco Products Database before you buy stock.
  • Search by brand, product name, and strength.
  • Save the authorization date in your records.

Warning Signs:

  • Avoid products labeled as FDA compatible or pending approval.
  • Avoid imported pouches from unknown brands.
  • Do not trust products that claim to be like ZYN.

3. MARKETING AND ADVERTISING

Federal rules restrict how you market nicotine pouches.

You cannot:

  • Claim pouches are safer than cigarettes.
  • Claim pouches help people quit smoking.
  • Mention health benefits without FDA approval.
  • Use cartoons or influencers to target youth.

You can:

  • Share prices and availability.
  • Describe flavors, strengths, and quantities.
  • Mention switching from cigarettes without claiming safety.

The FDA monitors social media. Violations lead to warning letters and fines.

4. PACKAGING REQUIREMENTS

Labels must include these warnings:

  • For sale to adults 21 plus only.
  • This product contains nicotine, an addictive chemical.
  • Nicotine is harmful to health and highly addictive.
  • Do not use if pregnant, nursing, or planning pregnancy.
  • Do not use if you have heart disease or high blood pressure.

The FDA now requires child resistant packaging. Use certified containers to avoid product denials. Pediatric poisoning cases are rising. The FDA uses this requirement to gatekeep new authorizations.

5. PACT ACT COMPLIANCE

The PACT Act regulates nicotine product shipping.

Rules:

  • Verify age before delivery.
  • Require an adult signature at delivery.
  • Use private carriers like UPS or DHL.
  • Do not use USPS.
  • Report sales to state tobacco tax administrators every month.

Your Actions:

  • Stop using USPS for all nicotine shipments.
  • Check IDs at the delivery point.
  • Keep detailed shipping records.
  • File state reports on time.

STATE COMPLIANCE

States set their own rules above federal laws.

These states follow general nicotine regulations. They have no special bans or taxes. States include Texas, Florida, Ohio, and Pennsylvania.
