GW Mobile App – Privacy Policy

This Privacy Policy explains how GW DESIGN & DISTRIBUTION INC. ("GW Products," "we," "us," or "our") collects, uses, and protects information when you use the GW Mobile App (the "App") on Google Play or the Apple App Store. The App is an extension of our existing B2B platform at www.gwproductsusa.com and is intended only for approved business customers.

This Policy works together with our website Privacy Policy at https://www.gwproductsusa.com/privacy. Where this Policy covers something specific to the App (for example, mobile device data or app-store features), this Policy applies. For anything not addressed here, our website Privacy Policy applies.


1. Who We Are

GW DESIGN & DISTRIBUTION INC. is a licensed wholesale distributor operating a B2B marketplace for regulated and non-regulated adult products in the United States. We serve verified distributors, retailers, and brands. We do not sell directly to consumers.

For purposes of GDPR (where applicable), GW DESIGN & DISTRIBUTION INC. is the data controller for personal information processed through the App.


2. Who Can Use the App

​• The App is for B2B use only by approved business customers (distributors, retailers, and brands).

​• Users must be at least 18 years old, and at least 21 years old where required for age-restricted product categories under federal, state, or local law.

​• The App is not intended for, and may not be used by, children. We do not knowingly collect information from anyone under 13 (and, in the App's context, anyone ​under 18).

​• Access requires an approved GW account. We may verify your business and age eligibility before granting access.


3. Information the App Collects

We collect information you provide and information collected automatically when you use the App. Business verification documents are used only for account approval, eligibility verification, compliance, fraud prevention, and administration of the B2B marketplace. We do not make these documents visible to marketplace sellers unless necessary to process an order, verify eligibility, comply with law, or with your consent.

​3.1 Information You Provide

​• Account information: name, business name, email, phone number, business address, tax ID, and login credentials.

​• Transaction information: orders, shipping and billing details, payment method references (handled by our payment processors), invoices, and order history.

​• Business and verification information: licenses, certifications, or other documents needed to verify your eligibility for age-restricted product categories.

​• Support and communications: messages you send through the App, including support requests, feedback, and any content you upload.

​3.2 Information Collected Automatically

​• Device data: device model, operating system and version, unique device identifiers, mobile network information, and language settings.

​• Log and usage data: IP address, app version, in-app actions, pages or screens viewed, session duration, timestamps, and crash reports.

​• Push tokens: if you enable push notifications, we receive a device token from Apple or Google so we can deliver notifications.

​• Approximate location: we may infer general location from your IP address. The App does not currently collect precise GPS location data. If we introduce a feature requiring precise location, we will request your permission before collecting it.

​• Cookies and SDKs: The App uses Google Firebase SDKs for analytics and crash reporting, including Firebase Analytics and Firebase Crashlytics. These SDKs may collect device, usage, diagnostic, crash, log, app-performance, and technical information.

​3.3 Information from Third Parties

​We may receive information from payment processors, identity-verification services, and our existing platform when you link or sign in with an existing GW account.


4. How We Use Your Information

We use information collected through the App to:

​• Create and manage your B2B account, including verifying eligibility for age-restricted categories.

​• Process orders, payments, shipping, returns, and customer support.

​• Authenticate logins and keep the App and your account secure.

​• Send service messages (order confirmations, shipping updates, account notices, security alerts).

​• Send push notifications and, where you have opted in, marketing or promotional messages.

​• Operate, maintain, debug, and improve the App, including analyzing performance and fixing crashes.

​• Detect, prevent, and respond to fraud, abuse, security incidents, and other harmful activity.

​• Comply with legal, tax, accounting, and regulatory obligations, including those related to age-restricted products.

​• Enforce our Terms & Conditions and protect our rights, property, and users.


5. Legal Bases for Processing (GDPR Users)

Where GDPR applies, we rely on the following legal bases:

​• Contract: to provide the App and fulfill orders.

​• Legitimate interests: to keep the App secure, prevent fraud, improve our services, and run our B2B business.

​• Legal obligation: to comply with applicable laws, including age-restricted product regulations and tax rules.

​• Consent: for marketing communications, certain analytics, and any optional permissions you grant in the App (e.g., notifications). You can withdraw consent at any time.


6. Third-Party Services Used by the App


We use Google Firebase services to operate, monitor, maintain, and improve the App. In particular, the App uses Firebase Analytics and Firebase Crashlytics.

Firebase Analytics helps us understand how approved business users interact with the App, including general usage patterns, app performance, screens viewed, session activity, and other analytics events. This helps us improve the App, troubleshoot issues, and develop better functionality.

Firebase Crashlytics helps us identify, investigate, and fix crashes, bugs, errors, and technical issues affecting the App. Crashlytics may collect crash reports, diagnostic information, device information, app information, operating system information, timestamps, and related technical data.

Depending on your use of the App, Firebase may process device and usage data, app activity data, diagnostic data, crash data, log data, device identifiers, IP address, app version, operating system information, and other technical information needed to provide analytics and crash-reporting services.

We do not use Firebase Analytics or Firebase Crashlytics for advertising, retargeting, cross-app tracking, behavioural advertising, or sale of personal information. We do not permit Google/Firebase to use App data for its own independent marketing purposes.

Firebase processes this information on our behalf to provide analytics, diagnostics, crash reporting, security, and app-performance services. For more information about Firebase’s privacy and security practices, please refer to Google’s Firebase privacy and security information.


7. How We Share Information

We do not sell your personal information. We do not use personal information collected through the App for advertising, retargeting, cross-app tracking, or behavioural advertising. We share personal information only as described below and only where necessary to operate, secure, support, improve, and provide the App and our B2B marketplace:

​• Service providers: as described in Section 6, under written agreements requiring confidentiality and security.

​• Vendors and sellers on our marketplace: to fulfill orders you place, we share necessary details (e.g., shipping address, order contents) with the relevant seller or fulfillment partner.

​• Legal and safety: to comply with laws, court orders, subpoenas, lawful requests from authorities, or to protect the rights, property, or safety of GW Products, our users, or the public.

​• Corporate transactions: in connection with a merger, acquisition, financing, reorganization, or sale of assets. We will notify you of any change in ownership or use of your personal information.

​• With your direction or consent: for any other sharing you specifically authorize.

Consistent with our website Policy, SMS and WhatsApp opt-in data is not shared with third parties or affiliates for their marketing purposes.


8. Data Retention

We keep personal information only for as long as needed for the purposes described in this Policy, including to provide the App, comply with legal obligations (such as tax and recordkeeping rules), resolve disputes, and enforce our agreements. We may retain order records, invoices, tax records, age-restricted product eligibility records, account verification records, and fraud-prevention records for longer periods where required or permitted by law. When data is no longer needed, we delete or anonymize it. 


9. Security

We use industry-standard administrative, technical, and physical safeguards to protect personal information, including encryption in transit (HTTPS/TLS), access controls, and secure infrastructure. No system is 100% secure, so we cannot guarantee absolute security. Please keep your login credentials confidential and notify us immediately if you suspect unauthorized access to your account.


10. International Data Transfers

GW DESIGN & DISTRIBUTION INC. is based in the United States, and information collected through the App is processed in the U.S. and other countries where our service providers operate. If you access the App from outside the U.S., your information will be transferred to and processed in the U.S. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers.


11. Your Rights and Choices

Depending on where you live, you may have the following rights:

​• Access: request a copy of the personal information we hold about you.

​• Correction: ask us to correct inaccurate or incomplete data.

​• Deletion: ask us to delete your personal data, subject to legal exceptions (for example, transaction records we must keep for tax or regulatory reasons).

​• Objection or restriction: object to certain processing or ask us to restrict it.

​• Data portability: request a portable copy of data you provided to us.

​• Withdraw consent: where we rely on consent (such as marketing), you can withdraw it at any time.

​• Marketing opt-out: unsubscribe from marketing emails, reply STOP to SMS, or disable push notifications in your device settings.


​11.1 California Residents (CCPA/CPRA)

​California residents have additional rights, including the right to know what personal information we collect, use, disclose, or sell; the right to delete; the right to correct; and the right to non-discrimination for exercising these rights. We do not sell personal information for money. We do not share personal information for cross-context behavioural advertising unless stated in this Policy and unless any legally required opt-out rights are provided.


​11.2 Texas Residents 

​If you are a Texas resident, you may have rights under applicable Texas privacy laws, including the right to access, correct, delete, and obtain a copy of certain personal data, and to opt out of certain processing where applicable.  If you are a Texas resident, you have rights under the Texas Data Privacy and Security Act, including the right to: (i) confirm whether we process your personal data and access that data; (ii) correct inaccuracies; (iii) request deletion; (iv) obtain a portable copy of data you provided; and (v) opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.

We do not sell personal data, do not use it for targeted advertising, and do not engage in profiling that produces legal or similarly significant effects.

If we decline your request, you may appeal by replying to our response or emailing info@gwproductsusa.com with the subject line "Texas Privacy Appeal." We will respond to appeals within 60 days as required by Texas law. If you are not satisfied with the outcome, you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov.


​11.3 How to Make a Request

​To exercise any of these rights, contact us at info@gwproductsusa.com. We may need to verify your identity before responding. We will respond within the timeframes required by applicable law.



12. Account Deletion

You may request deletion of your account and associated personal data at any time by:

​• Using the in-app account deletion option (where available);

​• Emailing info@gwproductsusa.com from the email address on your account; or

​• Visiting our website account settings.

Certain information may be retained as required by law or for legitimate business purposes (for example, tax records, fraud prevention, dispute resolution). This account-deletion option is provided to meet Google Play and Apple App Store requirements.


13. Children

The App is for business users only and is not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from a child, we will delete it. If you believe a child has provided us with information, contact us at info@gwproductsusa.com.


14. App Store Platforms

The App is distributed through Google Play and the Apple App Store. Your use of those platforms is also governed by Google's and Apple's own terms and privacy policies. App functionality may depend on services provided by Google, Apple, or your device manufacturer, and those companies may collect information directly from your device under their own policies.


15. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you through the App, by email, or by posting an updated version with a new "Last Updated" date. Your continued use of the App after the update means you accept the revised Policy.
